We, the People have lost more than Rs 12 Lakh Crores due to fraud by Bankers & others

During the past almost 72 years since the so-called ‘independence’ in 1947, We, the People have lost more money due to frauds committed by public sector undertakings, institutions and companies which are ‘regulated’ by instrumentalities of the State than in fraudulent transactions committed by private ‘unregulated’ entities. The difference between the two is huge and incomparable.

The public lost more than 12 lakhs Crores Rupees called NPAs. It may be noted that not a single rupee was stolen or robbed, yet huge sums of public money lost solely due to wrongful lending by corrupt bankers & decision-makers who lined their own pockets first with the substantial share in the ‘authorized & regulated’loot.

The ‘unregulated’ Shardha and many other similar ‘ponzi’ schemes by private players just pale in comparison when placed side by side with the mind-blowing ‘loot’ of public money by ‘regulated’ public sector companies, banks and institutions.

Take the example of unbearable loss caused by banks, Air India, MTNL, BSNL,SAIL, etc. which have been regularly bailed out with more public money year after year.

In this view of the shocking history of incalculable loss of public money, one is tempted to say not only our laws, but even the adjudicating and enforcement organs have been‘silent’ facilitators throughout this period.

The bigger tragedy has been when corrupt bankers got posted as high officials in CVC and CBI – which of late have been reeling with corruption charges leveled by their own one group of officials against the other. It is now well established that 75-80% of the total public money is lost majorly due to acts & omissions committed by senior management who use, as co-conspirators, their subordinate internal employees in banks and other public sector companies and organizations.

It is high time that end is put to this rotten state of affairs. The judges are the first independent public guardians who can arrest this growing menace … rather can nip this evil monster in the bud by refusing to grant Stay on court proceedings against rogue bankers in trial courts.

Against the Judiciary - Complaint 1:

1. That with due respect to You, the Hon'ble Judges, it would not be wrong to say that as per the scheme of the Constitution of India, the judiciary was given the power and duty to check and undo whenever it discovered commission of a wrongful act or omission by any of the governing organs. Courts of law were created to serve the cause of justice, truth, and equality for the people of this great ancient civilization. If a citizen complained of denial of justice of his/her right(s) guaranteed under the Constitution, it was seen that more injury and anguish was caused to the complainant by utter indifference and inaction on Your part than the original injury complained of by the victim. It is not being suggested that You have acted on the basis of any personal deficiency or bias or interest, but what is seen by an uninvolved person is that the judiciary members have been mostly passive or inactive in taking strict legal action against the wrongdoer on account of sheer disinterest, indifference and a tendency to keep the matter alive on the shelves of the record room of the court...for no personal gain...yet contrary to the principles of law, ethics and moral obligations. This creation of backlog of pending cases is wholly avoidable, and it does no good for any person. Rather, it does a disservice to 'We, the People' and the Nation in its growth...

But, first, let us meet the truest Hero - the Common Man/Woman who make together - 'We, the People'.

I found a perfect description of the Common Man/Woman in the expression of Shri Amitabh Bachchan (credit India Today): "It is the common man of our Nation, indeed of any Nation, that will and shall remain the truest hero. It is he that endures the rigours of life, set about by those that he through mandate appoints as managers of a nation. He places them with responsibility, for decision making, for protection, for guiding us and exploring ways and means of how they could better the life for him.

And, it is he who despite all this still remains a common man - unknown, invisible, undecorated, unrewarded and the bearer of the worst outcomes of another's deeds. It is he who bears the horror of separation when asked to leave his home and land, when countries face division and partition. It is he who is placed precariously on the 'fronts' then to defend any intrusions that may occur as a result of this. It is he, who unable to afford sufficient medical treatment, perishes during a plague or mass disease and epidemic. It is he who struggles to bear the 'costs' of a price rise in daily and essential consumables. It is he who becomes the largest victim of the terror attack. And yet it is he who will be first to be asked to endorse the course of action that a nation has chosen, and who will voluntarily and willingly do so" ... though, quite unknowing that he himself will be the first victim of that endorsement.

So, are You, the members of Judiciary, not aware of this gross injustice? Don't You have the power to act suo-motu to stop this wholly avoidable misery? Then, why maintain stoic silence? Why do You choose to fail him, Yourself and finally, the Nation?

Complaint on behalf of We, the people against They, the Wrongdoers

Complaint on behalf of We, the People against They, the Corrupt for the commission of wholly avoidable wrongs.

It is most respectfully stated that the abovenamed seven agencies have been failing in discharge of their moral, ethical and legal obligations/duties since the declaration of independence of India as an independent, sovereign State on 15th August 1947. What is worse is that these wrongdoers not only have been displaying an absolute disregard for the welfare of the people of the United States of India but have been sowing the seeds of discord among the highly diversified population of this great ancient civilization. The complaints, topic-wise, in brief, are as follows:
